Ultimate eBook License
By using and/or marketing Ultimate eBook, you agree to the following license in it's entirety. If you disagree with any part of this license you must discontinue use and marketing of Ultimate eBook and delete all copies you have.
This user license agreement (the AGREEMENT) is an agreement between you (individual or entity) and Affordable Internet Solutions, for Ultimate eBook, that is accompanying this AGREEMENT.
The SOFTWARE, Ultimate eBook, is the property of Affordable Internet Solutions and is protected by copyright laws and international copyright treaties. The SOFTWARE is not sold to you, it is licensed.
Licensed Version
The LICENSED VERSION means an original fully working version of The SOFTWARE. If you accept the terms and conditions of this AGREEMENT, you have certain rights and obligations as follow:
Registration
You must register your copy of Ultimate eBook with Affordable Internet Solutions. You will not be charged any additional fees for registering. This is to allows us to keep track of licensed users and deter violation of the license.
Passwords
Upon successful registration you will be sent a unique user name/password. This will be for your use only and can not be given to anyone else. It will also fully unlock Ultimate eBook for your use.
Updates
Once you have successfully registered Ultimate eBook you will receive a user name and password that will allow you to access all future versions of Ultimate eBook at no additional charge. You may not distribute your personal user name to anyone else.
At times you may be required to update Ultimate eBook. This will also be done at no additional charge.
Marketing
You may sell Ultimate eBook and use it's turnkey website with the following conditions:
Refunds & Exchanges
Refunds & Exchanges must be directed to the independent distributor/reseller of Ultimate eBook. Affordable Internet Solutions only provides refunds or exchanges to people who directly make their purchase from Affordable Internet Solutions.
Personalization
User agrees to not make available the version of Ultimate eBook that you can personalize. Nor will they make personalized versions for anyone else. It is only available from UltimateeBook.com. If you received a personalized version from any other location notify us.
Decompiling & Reverse Engineering
Decompiling & Reverse Engineering or modifying in any form of Ultimate eBook is strictly prohibited. Anyone caught doing this will be subject to prosecution and liable for direct or indirect damages by this action. You will also be charged a minimum $1,500 licensing fee on top of any damages.
Transfer of Rights
You may not transfer your rights to Ultimate eBook in any form. This includes but is not limited to the personalizable version.
License Modification
Affordable Internet Solutions may, at its discretion, modify or terminate this license with or without notice. It is the users responsibility to always have the current version which contains the current License Agreement.
Disclaimer of Profit
Affordable Internet Solutions makes no guarantee of actual profit from Ultimate eBook. All figures and examples used to promote Ultimate eBook are possible profits only.
Disclaimer of Damages
The SOFTWARE is supplied "AS IS". In no event shall Affordable Internet Solutions be liable for any damages whatsoever (including, with limitation, damages for loss of business profits, business interruption, or other pecuniary loss) arising out of the use or inability of this software product, even if Affordable Internet Solutions has been advised of such damages. The user must assume the entire risk of using the SOFTWARE.
Notification of Distribution
At the request of Affordable Internet Solutions, either by email, phone, postal mail or other forms of communication, you must supply the site(s) that you sell the software from and the download page.
Termination
Either party may terminate this AGREEMENT immediately in the event of default by the other party. Upon any termination of this AGREEMENT, you shall immediately discontinue the use of the software and destroy all backups you may have made. You may also terminate this AGREEMENT at any time by destroying the software, documentation and all copies of thereof. Your obligations to pay accrued charges and fees shall survive any termination of this AGREEMENT.
Violations
Violating this AGREEMENT in any form will result in a forfeit of your license. It may or may not also result in you paying fees to recover from damages caused by your violation.
Additionally, you are liable to Affordable
Internet Solutions for damages of not less than $97 $47.00 per copy distributed
in violation.
Disclaimer of Warranty
Affordable Internet Solutions disclaims all warranties relating to this software or information, whether express or implied, including but not limited to any implied warranties of merchantability and fitness for a particular purpose, and all such warranties are expressly and specifically disclaimed. Neither Affordable Internet Solutions nor anyone else who has been involved in the creation, production, or deliver of this software shall be liable for any indirect, consequential, or incidental damages arising out of the use or inability to use such software or information even if Affordable Internet Solutions has been advised of the possibility of such damages or claims. In no event shall Affordable Internet Solutions liability for any damages ever exceed the price paid for the license to use or market the software, regardless of the form of claim. The person(s) using the software or information bears all risk as to the quality and performance of the software or information.
Some states do not allow the exclusion of the limit of liability for consequential or incidental damages so the above limitations may not apply to you.
Other Terms and Conditions
A. All previous versions and licenses have
been withdrawn.
B. Your right to distribute under this license does not include any right
to sublicense the software.
C. Except as expressly licensed by Affordable Internet Solutions, we have
and reserve the exclusive copyright and all other rights, title and interest
to distribute this software and to use trademarks in connection with them.
D. With the respect to every matter arising under this license, you consent
to the exclusive jurisdiction and venue of the sate and federal courts sitting
in Mayfield, Kentucky, and to service by certified mail, return receipt
requested, or as otherwise permitted by law.
| THIS AGREEMENT SHALL BE GOVERNED BY THE LAWS OF THE STATE OF KENTUCKY AND SHALL INURE TO THE BENEFIT OF AFFORDABLE INTERNET SOLUTIONS AND ANY SUCCESSORS, ADMINISTRATORS, HEIRS, AND ASSIGNS. ANY ACTION OR PROCEEDING BROUGHT BY EITHER PARTY AGAINST THE OTHER ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL BE BROUGHT ONLY IN A STATE OR FEDERAL COURT OF COMPETENT JURISDICTION LOCATED IN GRAVES COUNTY, KENTUCKY. THE PARTIES HEREBY CONSENT TO IN PERSONAL JURISDICTION OF SAID COURTS. |
